Accessing and/or using this website confers upon you the status of user, which you accept. From that moment, these conditions apply to you as well as to us.
This document sets out the terms and conditions governing the purchase and sale of products through this website (hereinafter “Purchase Conditions”). The content of our “Legal Notice and General Terms of Use” and our “Privacy Policy” also applies. Please consult them before using this website or placing an order through it. If you do not agree with its content, you should not use this website.

1.1. Through this website, sales will only be made for orders originating from and with a delivery address in the following countries:
Germany, Andorra, Australia, Austria, Belgium, Bulgaria, Canada, Cyrus, Vatican City, Denmark, Slovakia, Slovenia, Spain, USA, Estonia, Finland, France, Greece, Holland, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Mexico, Monaco, Norway, Poland, Portugal, Puerto Rico, UK, Czech Republic, Romania, Sweden, Switzerland.
All sales to these countries will be made by HOLA GUILLE SL
1.3. When making your purchase through our website, you can either enter your personal data only in relation to the order and purchase you wish to make at that time, or enter it to register as a user, both to make that order and any other in the future, which will also allow you to enjoy a series of advantages.

Buyer:
The user who enters their personal data in the purchase form, having previously accepted these Purchase Conditions and the Privacy Policy (hereinafter “you”, “user” or “Buyer”).
3.1. Placing an order through our website implies acceptance by the Buyer of these Purchase Conditions and the Privacy Policy included on this website.
3.2. The contract may be formalized, at the Buyer's option, in any of the languages in which these Purchase Conditions are available on this website.
3.3. Orders placed by the Buyer are subject to acceptance by the Seller. This acceptance, or, if applicable, non-confirmation of the order, will be communicated via email.
4.1. The Buyer must be of legal age and have the legal capacity to enter into contracts.
4.2. The Buyer shall use this website only to make legally valid inquiries, requests or orders.
4.3. The Buyer must provide their email address, postal address and/or other contact details requested in a truthful and accurate manner, consenting to the Seller's use of this personal data when necessary and as provided in the Privacy Policy included on this website.
4.4. The Buyer must pay the agreed price using any of the methods provided on this website.
5.1. The Seller's main obligation is the delivery of the products requested by the Buyer through their online order that have been accepted by the Seller by email confirmation, taking into account the conditions set out below:
5.1.1. All orders are subject to the availability of the requested products. If the product you have selected is unavailable, we will inform you as soon as possible and your payment will be refunded via the same payment method you used.
5.1.2. Unless unforeseen circumstances arise or are beyond our control, we will send you the products listed in each order confirmation within seven (7) business days. In no case will we exceed the maximum legal period of thirty (30) days from the date of your order confirmation.
5.1.3. If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option of proceeding with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid.
5.1.4. Delivery of the order will be deemed to have taken place when the Buyer, or a third party on their behalf, acquires physical possession of the products, which will be evidenced by the signature of receipt of the order at the agreed delivery address.
5.1.5. If neither you nor someone on your behalf will be at the delivery address at the agreed time, you must contact us with reasonable advance notice to arrange delivery on another day. If we are unable to deliver your order because no one will be home to receive it, we will attempt to contact you to find an alternative date or location. If we are unable to reach you or find a suitable alternative, your order will be returned to our warehouse, and we will leave you a notification so that, if you wish, it can be reshipped.
5.1.6. If fifteen (15) days have passed since the first date on which we attempted to deliver your order without the order having been delivered for any reason not attributable to HOLA GUILLE, we will consider the sales contract terminated and will return all amounts received from you within a maximum period of ten (10) days from the date on which we consider the contract terminated, but deducting the shipping costs and the costs of returning the product to our warehouse, in addition to any tax or fee that we have had to pay in relation to the shipment.
5.2. HOLA GUILLE will not be liable for any failure or delay in the performance of any of its obligations when such failure or delay is due to events beyond its reasonable control.
6.1. The price of our products, including applicable VAT and shipping costs, will be displayed on the screen during the order process before you confirm it. These prices will correspond to the country you have selected as the destination for the goods. If you change the destination country, the prices and shipping costs may change.
6.2. HOLA GUILLE may modify the price of the products and shipping costs at any time, without prior notice, although HOLA GUILLE will always apply the price in force at the time of receipt of your purchase order.
6.3. You expressly authorize us to issue your invoice in either electronic or paper format. We will normally send it to you on paper, unless you are making a gift purchase – in which case it will be sent electronically and only to you. If you have a preference in this regard, or if you wish to exercise your right to receive it on paper, please let us know by contacting us at the telephone numbers and addresses listed in the section. "Customer Service"
7.1. For purchases made through this website, payment is accepted by credit or debit card and also through Paypal.
7.2. The card details that the Buyer enters in the purchase form will be transmitted via a secure connection directly to the bank, so the Seller will not have access to these details.
7.3. The price of the products ordered must be paid in euros.
7.4. By authorizing payment, you are confirming that you are the legitimate cardholder. To minimize the risk of unauthorized access, your credit or debit card details will be encrypted. Credit or debit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, we will not be able to enter into a contract with you or sell you our product.
8.1. Shipments will be notified to the Buyer via email. The product will be delivered to the address provided when placing the order, as long as it is in one of the countries listed in clause 1.1 and is not a P.O. box. Due to the shipping methods used for our product, we cannot accept P.O. box addresses.
8.2. After notification of shipment you will receive the goods within the period indicated in clause 5.1.2 of this document.
8.3. The risks associated with the products shall pass to the Buyer upon delivery. The Buyer shall acquire ownership of the products when the Seller receives payment of the price (and any other amounts due, including shipping costs), or upon delivery if delivery occurs at a later time.
9.1. HOLA GUILLE will accept the return of any product that has been damaged during transport or that has a manufacturing defect.
9.2. In the case of breakage or damage, the Buyer will have 24 hours from the moment they receive the product to contact our Customer Service Department in writing, where they will be informed of the procedure for returning the merchandise.
9.3. If it is a manufacturing defect, the Buyer must inform HOLA GUILLE (Customer Service Department) as soon as they notice it and they will be informed of the procedure for making the return.
9.4. It should be noted that HOLA GUILLE crafts its products using a traditional process, making each piece unique and unrepeatable. Therefore, each piece may exhibit slight variations from others in the series. Images of the pieces may also differ slightly from the original models. None of these variations or differences constitute a manufacturing defect. On the contrary, they add value to each piece.
10.1. As a consumer, you have a period of thirty (30) calendar days from the receipt of the product at the address indicated to withdraw from this purchase without needing to provide justification.
10.2. To exercise this right of withdrawal, you must send us, within the period indicated above, a written notification to guille@garcia-hoz.com with an unequivocal statement of your intention to withdraw from the contract (you may, if you wish, use the model withdrawal form available in our Frequently Asked Questions section). Our Customer Service Department will promptly acknowledge receipt of your withdrawal by email and will contact you to explain how to return the product. We will collect the product from your address within ten (10) calendar days of receiving your notification of withdrawal. The product you return must be in perfect condition and in its original packaging, subject to the exceptions outlined in Article 11.4.
11.3. Once the Seller has received the product, they will refund all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offered). These amounts will be refunded using the same payment method used for the initial transaction and within a maximum of thirty (30) calendar days from the date on which we are informed of your decision to withdraw from this contract, provided that we have received the returned product within that period.
11.4. Exceptions to the right of withdrawal
You will not have the right to withdraw from a contract whose object is the supply of any of the following products:
- Customized products.
- Candles or “Home Fragrances” products that have been unsealed after delivery.
- Earrings / Personalized jewelry (for hygiene reasons).
The right to withdraw from the contract only applies to products returned by the Seller in the same condition in which they were received. No refund will be issued if the product has been used, is not in the same condition as when delivered, or has been damaged (except as provided in Article 9). The product must be returned with all original packaging, warranty leaflets, instructions, and any other accompanying documents.
As soon as taxes at source For purchases subject to VAT, Value Added Tax (VAT) will be applied at the rate in effect at any given time to all shipments to countries within the European Union, with the exception of the Canary Islands, Ceuta, and Melilla. All other countries and territories are exempt from this tax. If you are acting as a business or professional, please contact us for VAT information (see contact details in the "Customer Service" section).
As soon as Destination taxes , duties, taxes, and any charges associated with customs clearance are the responsibility of the recipient of the product, in accordance with the legal regulations in each country. The recipient must pay these charges in cash upon receipt of the shipment. We have no control over these charges and cannot predict their total amount, so we recommend contacting the customs office for further information.

The Buyer acknowledges and agrees that all copyright, trademarks, and other intellectual property rights in the materials or content included on this website belong to HOLA GUILLE or its licensors (see the "Purchase Notice and Terms of Use" on this website). You may only use such material as expressly authorized by us or those who have licensed it to us.
15.1. By entering into this agreement and using this website, you agree that communications with us may be electronic and acknowledge that all contracts, notices, information and other communications that we send you electronically satisfy the legal requirement of being in writing.
15.2. Notifications that you send to us must be sent through our email address guille@garcia-hoz.com
15.3. We may send you communications either to your email address or to the postal address you provided when placing your order.
This sales contract is governed by Spanish law.
